A grand jury (not a public jury trial) may offer witnesses immunity from prosecution in exchange for their testimony. Once offered this immunity, a witness may not use the Fifth Amendment to avoid testifying without risking contempt of court charge and an automatic jail sentence, equal to the length of the time the grand jury convenes. If a witness accepts immunity, then refuses to testify, and is jailed, are his or her rights violated? Why or why not?
