There is no military Conscription at present (the U.S. has had a military volunteer force since 1973), but President Jimmy Carter asked Congress to require both men and women to register for the draft after the Soviet Union invaded Afghanistan in 1979. Registration was designed to facilitate any eventual conscription. In 1980, Congress reinstated registration for men only, a policy that was not universally popular. Federal courts ordered registration suspended while several young men filed a suit. These men argued that the registration requirement was gender-based discrimination that violated the due process clause of the Fifth Amendment.
you be the Judge: Does requiring only males to register for the draft unconstitutionally discriminate against them?
