A plaintiff was involved in a high-speed collision on the San Diego freeway. A sideswipe occurred between the plaintiff's pickup truck and a trailer truck. The sideswipe caused the plaintiff's truck to careen down the road and into an embankment. The plaintiff was not hurt badly, but her pickup and the load of furniture she was hauling was totally destroyed. At trial, the plaintiff called a witness to the collision to testify that she heard an unidentified high-pitched voice scream, Oh, my God, that trailer truck sideswiped that poor little pickup. How should the trial judge rule on this testimony?
