Before You Begin
You will be responsible for selecting the policies and Supreme Court decisions you believe have had the greatest impact on the rights of specific racial, ethnic, and religious groups. However, here are some key events to consider.
Civil Rights Act of 1964: This act made segregation of all public places illegal. Prior to this act, cities could maintain separate facilities for white and black Americans. There were separate schools, buses, businesses, restrooms, hospitals, and theaters. This segregation was made possible by the Supreme Court ruling in Plessy v. Ferguson, which established the policy of “separate but equal.” While facilities were separate, they were hardly equal. The Civil Rights Act of 1964 sought to extend the rights of white citizens to African Americans, including the opportunity to enroll in school, that were previously denied them.
Hernandez v. Texas: This case, which went before the Supreme Court in 1954, concerned Pete Hernandez, a Mexican American farmworker accused of murder in 1950. Hernandez was found guilty of the charge by an all-white jury. He sued the state, arguing that he did not receive a fair trial because the jury did not represent his peers. The Supreme Court ruled in favor of Hernandez and dismissed his conviction. The Court maintained that the state of Texas denied Hernandez his 14th Amendment rights by excluding Mexican Americans from juries.
Grutter v. Bollinger: This 2003 Supreme Court case involved a suit by Barbara Grutter against the University of Michigan. Grutter argued that her 14th Amendment rights were violated when she was denied admittance into the University’s school of law. She maintained that the school’s affirmative action policies made race a primary factor for admission and excluded white applicants such as her. The Supreme Court ruled against Grutter, stating that because the school’s affirmative action policies were aimed at creating diversity and led to the inclusion of students who would historically have been excluded from the program because of race or ethnicity, they were not unconstitutional.
