In 2001, the FDA filed a case against Hit Products, Inc. for the company's violation of the Federal Food, Drug, and Cosmetic (FD&C) Act. Hit Products, Inc. was accused of falsely branding its products (herb mixtures) as dietary supplements and alternatives to street drugs, giving a sort of "legal high" to its consumers.

The court sided with the FDA, and declared the company's misrepresentation of its products as an attempt to circumvent the law. Also, the court refused to give drug manufacturers a statutory loophole to disguise illegal drugs as legal supplements.
