Here , we choose the 10 marbles from the box of 40 marbles without replacement  

Therefore , probability is changes for every time  

Also , the trials are dependent  

Therefore ,the assumptions of binomial distributions are not satisfied

Therefore ,  Not binomial : the trials are not independent
