Parties to the contract and band members
The names of the permanent members of the band must be indicated, which in turn will be firm parties to the agreement. The ideal is to specify as much as possible in terms of attending rehearsals, concerts, promotional activities, ... It is also good to collect the assignment of these accessory functions that part of the band develops when there is no delegate in a manager, hiring agent, ...
The serious breach of these obligations can be penalized with the expulsion of the band or with an economic amount, in which case the cases of serious breach will have to be defined.
Bass band musicians
A musician can temporarily or permanently leave your band. To avoid internal escalations or tensions due to absences in rehearsals and concerts, in sick leave or accident, it can be established that it is sufficient to present to the rest of the classmates the medical proof; If the reason is different, such as personal matters, maximum periods of absences and forced leave can be agreed if these are exceeded, unless authorized by a majority. For its part and according to the contract, the rest of the band should be allowed to continue with the activity and find a substitute musician.
It is also convenient to establish the causes that can cause the expulsion of the band as well as the mechanisms to select a new permanent member.
Rights of musicians
The musician of a band will be entitled to participate in the artistic activity and the profits generated, as well as to have a percentage of ownership over the band's assets: material assets (instruments, equipment, vehicles, ...) and intangibles (rights of intellectual property, brands, ...).
Income and expenses
Another fundamental aspect of the musical group contract is to establish the percentage of income participation, as well as the criteria for approving expenses. As we saw in the previous point, the participation in the benefits generated by the band will depend on the percentage of participation that has been agreed for each of the musicians.
But it is advisable to establish amounts of reserves or capitalization of the group, which means that benefits will only be distributed from certain invoiced amounts, with the aim of guaranteeing the solvency of the band and the possibility of reinvesting in marketing, promotion, instruments, services professionals, ... Likewise, the criteria to determine the necessary or advisable expenses should also be provided in the contract or, failing that, minimum rules to vote on these issues.
