The state government of New York had actually issued the licence to the steam boat company to operate between Elizabeth town Point in New Jersey and New York City. In the same route another steam boat owner, who is also the partner of Ogden had been running his boat with the coasting licence issued by the federal government. Ogden felt that gibbons was interfering in his route and unfairly cutting down his business. Ogden filed a complaint in New York to make Gibbons stop the ferry service on the same route.

Ogden argued that the license which was given by the New York state is valid but Gibbons disagreed saying that the US constitution gave the Congress full powers to regulate the interstate commerce. Supreme court had also ruled the same that the federal government has all powers to regulate interstate trade and thus the commerce class specified in the constitution clearly states that the congress had all powers to regulate and manage the interstate commerce and trade.
