A petty crime would be stealing a piece of candy from the local candy store that cost 25 cents. A cruel punishment would be that the person would have to go to jail for the rest of their life. The importance of having the 8th amendment would prevent something like that from happening. Under the 8th amendment the punishment should be equal to the crime that was committed. If we did not have the 8th amendment then in the scenario given you could be put to death for petty crimes.
