No it was not fair that they signed a document celebrating liberty and freedom when they did not protect the rights of slaves as well, because if you are going to celebrate liberty and freedom when Slaves have very little to none of both why celebrate it and say that everyone has freedom, that everyone has liberty. Fairness means that both sides are equal, that both sides are compatible, but if you are celebrating something that everyone else has except for a group of people, where is the fairness in that. Liberty means the state of being free within society from oppressive restrictions imposed by authority on one's way of life, behavior, or political views but slaves didn't have any of that. They had constraint or limitation/restriction from their rights. Basically their only rights when around white people was to do what they were told and obey their upperclassmen, keep their mouths shout, and their eyes low. No it was definitely not fair, it was not fair for the children of slaves who when their parent or guardian died because they tried to fight for their liberty or fight for their rights and got struck down because of it.
