A motion for new trial
This can simply be due to any alleged omission or error on the part of the trial court and when it is granted, the case will be re-tried and original trial we be termed ''never happened".
It can be granted only when it must be filed in court within 30 days of pronouncement of sentence; and presented to the court within 10 days of filing. Usually, the court permits case presentation within 75 days from when sentencing was done.
The reasons for a new trial to be Granted includes
1. Continuing trial when defense is required to be present and was not.
2. Verdict was decided by lot
3. Defense's right to adequate counsel was ignored or violated
4. A juror was bribed or engaged in other corrupt conduct
5. A juror tells another who is not on the jury about the case and also when;
6. New evidence has been discovered.
