During Thomas Jefferson's administration, the Supreme court established the policy of judicial review through its decision in the landmark case Marbury v. Madison. The policy of judicial review establishes that the Supreme Court has the right to declare an act of Congress C. Unconstitutional.
Marbury v. Madison established that the Supreme Court has the power to declare an act of Congress unconstitutional if it is inconsistent with the Constitution. This principle, which still persists today, also reaffirmed that the Constitution, not Congress, is the supreme law of the land and trumps the actions of the other branches.
