Because on April 6th, 1865, at the Battle of Sailor's Creek it was becoming clear that the once highly praised or boasted and bragged about army of Northern Virginia was dissolving. Then rather than pursue a path of more death and bloodshed,grant reached out to Lee asking him to surrender. Lee, still not ready to surrender, continued to have a conversation or continued to talk to grant hoping that he could escape the growing Union stranglehold. Only after being defeated or losing at Appomattox station on April 8th, 1865, where critical supplies were captured/taken and appomattox court house on april 9, 1865, did Lee finally agree to Grant's surrender terms.
