This issue regarding the legal status of slaves was brought up after Dred Scott sued from his freedom since he lived with his master in a free territory. The Supreme Court ruled against Scott and ruled that slaves are property. This essentially allowed slavery to exist anywhere in America, even if a state already outlawed the institution.
