The answer is the Necessary and Proper clause or also known as the elastic clause. This found in Article 1, Section 8, Clause 18. It is stated there that, “The Congress shall have Power To ...make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Government of the United States, or in any Department or Officer thereof.” In short, this allows the Congress to make laws it needs to carry out its own powers. Also, it grants Congress the powers that are inferred in the Constitution, but that are not explicitly stated. That is why the powers which is from the Necessary and Proper Clause are denoted to as implied powers.
